On August 18, 2014 the United States District Court for the Northern District of Texas approved the Laboratory Technicians’ request to conditionally certify the case as a collective action and allowed a notice to be sent to all Lab Tech II and Lab Tech III employees. If you were employed by FSNS as a Lab Tech II or Lab Tech III after August 18, 2011 you will be receiving by mail a Notice of your right to join the lawsuit. If you want to participate in the lawsuit you will need to sign and return the Consent to Join Form that will be included with the Notice.
On June 3, 2014 the Company offered to pay overtime to the four individuals that had joined the lawsuit as of that date. The Company made an “Offer of Judgment.” You can read the offer here. The Company offered to pay the four individuals a total of $13,066.90 plus costs and attorneys fees and offered to have a judgment entered against it in the United States District Court for the Northern District of Texas. The Offer of Judgment was not accepted by the plaintiffs.
On June 4, we filed a motion asking the Court to approve a Notice to all current and former Lab Tech IIs and IIIs informing them of their ability to opt-in to the case. You can read our motion here. Motion for Notice.
In this case we are seeking recovery for overtime worked by laboratory technicians who we allege were improperly classified as “exempt” employees and improperly denied overtime pay.
