A class has been conditionally certified as follow:
All current and former individuals employed by Examination Management Services, Inc. (“EMSI”) who (1) worked between August 29, 2010 and [the date the Court enters the order]; (2) performed paramedical examinations and/or drug and alcohol screens for which they were compensated on a commission and/or per exam basis; and (3) worked more than forty (40) hours during any workweek.
